Our Specialty

Professional Process Serving in the San Francisco Bay Area

Process serving is the foundation of due process in the American legal system. The right to be notified of legal action is protected by the United States Constitution, and proper service of process ensures that every party receives fair notice. At Legal Servers, every serve is handled by a California registered process server who understands the legal requirements, the urgency of your court deadlines, and the specific rules of each Bay Area county courthouse.

Whether you are an attorney at a large San Francisco law firm, a solo practitioner in Walnut Creek, or a self-represented litigant filing in Contra Costa County Superior Court, Legal Servers provides the same level of professional, reliable, and legally compliant service. We proudly serve legal documents across San Francisco, Contra Costa, Alameda, Marin, Santa Clara, San Mateo, Sacramento, San Joaquin, and Sonoma counties every day.

What Is Process Serving and Why Does It Matter?

Process serving is the legal procedure of delivering court documents, such as a summons, complaint, subpoena, or restraining order, to an individual or business involved in a legal proceeding. In California, process serving must comply with the California Code of Civil Procedure, which outlines specific rules for how, when, and where documents can be served. Failure to properly serve documents can result in delays, dismissed cases, or judgments being overturned on appeal.

A registered process server is an individual who has met the requirements set forth by the county in which they operate. In California, process servers must register with the county clerk and carry proper identification. Legal Servers employs only registered, experienced process servers who are trained in California service of process laws, courtroom procedures, and professional conduct. Our servers are bonded and insured for your protection.

Hiring a professional process server offers significant advantages over attempting service yourself. Professional servers understand the rules governing service in each jurisdiction, can navigate complex situations like evasive defendants or gated communities, and provide notarized proof of service that courts accept without question. Legal Servers has successfully completed service in thousands of cases across the Bay Area, including difficult serves that other companies have been unable to complete.

Personal Service

Hand delivery of legal documents directly to the named individual, meeting all California Code of Civil Procedure requirements for personal service. Our registered process servers ensure every personal service attempt is documented with GPS coordinates, timestamps, and a physical description of the person served. Personal service is the gold standard in due process, and Legal Servers takes pride in getting it right the first time.

Substitute Service

When personal service is not possible after diligent attempts, we perform compliant substitute service at the recipient's home or workplace, followed by mailing as required by California Code of Civil Procedure Section 415.20. Our process servers document every detail of substitute service including the name and relationship of the person accepting service, ensuring your proof of service holds up in court.

Sub-Service & Post-and-Mail

For cases requiring alternative methods, we handle sub-service, post-and-mail, and service by publication in accordance with court authorization. When traditional methods are not feasible, Legal Servers works with your legal team to pursue court-ordered alternative service methods. We prepare all necessary declarations and filings to support your motion for alternative service.

Due Diligence & Declarations

Detailed declarations of due diligence documenting every attempt, including dates, times, locations visited, physical descriptions of premises, and notes on each visit. Our declarations of due diligence meet the highest standards required by California Superior Courts and are prepared to withstand scrutiny during any challenge to service. We understand that proper documentation protects your case.

Proof of Service Filing

We prepare and file your proof of service with the court, ensuring all affidavits are properly notarized and comply with jurisdictional formatting rules. Every proof of service from Legal Servers includes GPS verification, time-stamped photographic evidence, and detailed server declarations. We file with the court clerk on your behalf so you receive a conformed copy quickly.

Rush & Same-Day Service

Need urgent service? We offer same-day and rush service throughout the San Francisco Bay Area with priority handling and real-time status updates. Whether you are facing a filing deadline, a hearing date, or an expiring statute of limitations, Legal Servers has the capacity and local presence to serve documents quickly across Contra Costa, Alameda, San Francisco, and all Bay Area counties.

California Process Serving Laws and Compliance

California Code of Civil Procedure

California law provides several methods for service of process, each with specific requirements. Under CCP Section 415.10, personal service requires hand-delivering the documents to the named party. When personal service fails after reasonable diligence, CCP Section 415.20 allows substitute service by leaving documents with a competent adult at the person's home or workplace and then mailing a copy. CCP Section 415.30 permits service by mail with acknowledgment of receipt, and CCP Section 415.50 allows service by publication when all other methods have been exhausted. Legal Servers is experienced in all methods and will recommend the most effective approach for your situation.

Timelines and Deadlines

Understanding service deadlines is critical to your case. After a civil complaint is filed in California, the plaintiff generally has 60 days to serve the defendant under California Rules of Court Rule 3.110. For unlawful detainer actions, strict service timelines apply depending on the type of notice. A 3-day notice to pay rent or quit, 30-day notice to terminate tenancy, or 60-day notice each carry different requirements. Legal Servers helps attorneys and self-represented litigants stay on schedule by providing prompt, priority service that meets all statutory deadlines. We understand that missing a service deadline can delay your entire case, and we work diligently to prevent that from happening.
